PRIVACY POLICY AND PERSONAL DATA PROTECTION
The management of information under this Privacy Policy and Personal Data Protection (hereinafter referred to as the "Privacy Policy") is carried out by the individual entrepreneur Yulia Volodymyrivna Sydoruk (extract from the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Formations No. 577811106090, dated August 28, 2024), who is registered and operates in accordance with the requirements of the legislation of Ukraine (hereinafter referred to as the "Site Administration").
The Privacy Policy applies to all information that the Site Administration receives about the User when using the Website at the following link: https://pride-salon.com/
Please note that this Privacy Policy has been prepared in consideration of the latest changes in legislation regulating the protection of personal data, specifically taking into account the requirements of the General Data Protection Regulation (EU Regulation No. 2016/679 of April 27, 2016, or GDPR - General Data Protection Regulation).
1. DEFINITIONS OF TERMS
1.1. This section defines the interpretation of the terms and definitions used in this Agreement.
1.1.1. "Website" – a web page located at the domain name: https://pride-salon.com/ and managed by the Service Provider, including all information, texts, graphic elements, design elements, images, and photographic materials posted on the Website, as well as the informational and technical resources of the Website.
1.1.2. "User" – any natural person who has access to the Website and uses it via the Internet.
1.1.3. "Personal Data" – any information that directly or indirectly relates to a specific natural person (data subject).
1.1.4. "Processing of Personal Data" – any action (operation) or a set of actions (operations) performed using automation tools or without such tools concerning personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, usage, transfer (distribution, provision, access), blocking, deletion, or destruction of personal data.
1.1.5. "Confidentiality of Personal Data" – a mandatory requirement for the administration or any other person who has access to personal data to prevent its dissemination without the consent of the data subject or the existence of another legal basis.
1.1.6. "Cookies" – a small piece of data sent by a web server and stored on the User's computer, which is transmitted by the web client or web browser to the web server in an HTTP request when attempting to open a page of the corresponding website.
1.1.7. "IP Address" – a unique network address of a node in a computer network built according to the IP protocol, which allows identifying the location and other information about the User.
1.2. Terms and definitions not specified in this section shall be interpreted in accordance with the applicable legislation of Ukraine, and in the absence of such a definition, in their usual meaning.
2. GENERAL PROVISIONS
2.1. The User's use of the Website constitutes their automatic and full agreement with the Privacy Policy and the terms of personal data processing outlined therein.
2.2. If the User does not agree with the terms of the Privacy Policy, they must cease using the Website and leave it immediately.
2.3. This Privacy Policy applies to the Website.
2.4. The Website Administration does not control and is not responsible for third-party websites that the User may access through links available on the Website.
2.5. The Website Administration does not verify the accuracy of personal data provided by the User.
2.6. The Website Administration is the controller of the Users' personal data. A personal data controller is a person who determines the purposes and means of collecting personal data.
3. AGE RESTRICTIONS
3.1. By placing an order for Services on the Website, the User confirms that they have reached the appropriate age that allows them to independently enter into such agreements.
3.2. If the Website Administration requests the User’s consent to process personal data, they may provide such consent independently. By agreeing to the Privacy Policy on the Website, the User confirms that they have reached the appropriate age to independently consent to the processing of personal data.
3.3. If the User has doubts about whether they can independently consent to the processing of personal data, they should contact the authorized personal data protection authority.
3.4. The Website Administration may request additional documents or require the User to undergo additional verification procedures to ensure that they have the right to independently consent to the processing of personal data. If the Website Administration has reasonable doubts about the User’s age, it may also contact the User’s parents or guardians to obtain consent or approval for the processing of the User’s personal data if they have not reached the appropriate age. During the verification process or while obtaining consent or approval from parents or guardians, the Website Administration may limit data processing by temporarily suspending the provision of Services.
4. SUBJECT OF THE PRIVACY POLICY
4.1. This Privacy Policy establishes the obligations of the Website Administration regarding the non-disclosure and protection of the confidentiality of personal data that the User must provide to the Website Administration when placing an order for Services.
4.2. The personal data permitted for processing under this Privacy Policy is provided by the User by filling out specific forms on the Website or in a free format and may include the following information:
4.2.1. User's last name and first name;
4.2.2. User's contact phone number;
4.2.3. User's email address (e-mail);
4.2.4. Other confidential data about the User's identity or User's contacts.
4.3. In addition to the data specified in clause 4.2 of this Privacy Policy, the Website Administration reserves the right to automatically collect the following data while the User browses the Website or its individual pages:
4.3.1. IP address of the User’s electronic device (computer, phone, tablet, etc.);
4.3.2. Information about cookies stored in the User's browser;
4.3.3. Information about the User’s electronic devices (computers, phones, tablets, etc.);
4.3.4. Information about the User’s browser, including name, version, etc.;
4.3.5. Time of access to the Website;
4.3.6. URLs of the Website pages viewed by the User;
4.3.7. URLs of previous pages from which the Website was accessed.
4.4. Disabling the collection of Cookies by the User may result in limited access to certain parts of the Website.
4.5. The Website collects confidential data specified in clauses 4.2 – 4.3 of this Privacy Policy, including for the purpose of detecting and resolving technical issues of the Website, monitoring website load, and conducting statistical calculations on the effectiveness of advertising campaigns.
4.6. Any other personal or confidential information not specified above is subject to secure storage and non-disclosure, except in cases provided for in clauses 7.2 and 7.3 of this Privacy Policy.
5. PURPOSES OF COLLECTING USER'S PERSONAL INFORMATION
5.1. The Website Administration may use the User's personal data for the following purposes:
5.1.1. Identifying the User who has ordered and/or paid for services on the Website for the purpose of joining the public offer agreement remotely;
5.1.2. Establishing feedback with the User, including sending messages, inquiries related to the use of the Website, providing services, processing requests, and applications from the User;
5.1.3. Verifying the accuracy and completeness of the personal data provided by the User;
5.1.4. Notifying the User about the status of service orders;
5.1.5. Providing the User with effective customer and technical support in case of issues related to the use of the Website;
5.1.6. Providing the User, with their consent, updates, special offers, pricing information, news, and other information on behalf of the Website Administration;
5.1.7. Conducting advertising activities with the User's consent;
5.1.8. Determining the User's location to ensure security and prevent fraud.
5.2. The User's personal data may be used for other purposes not specified in this Privacy Policy but falling within the scope of the Website's activities and service provision.
6. DATA STORAGE
6.1. The Website Administration stores the User's Personal Data only for as long as it is needed by the User or the Website Administration for the purposes specified in this Privacy Policy. This also applies to any third party acting on behalf of the Website Administration. If the Website Administration no longer requires certain User data and its storage is not mandated by law, the data will be deleted or stored in a way that prevents User identification.
7. METHODS, PROCEDURE, AND TERMS OF PERSONAL INFORMATION PROCESSING
7.1. The processing of the User's personal data is carried out without time limitations by any legal means, including within personal data information systems, with or without the use of automation tools.
7.2. By staying on the Website, the User automatically agrees that the Website Administration has the right to transfer personal data to third parties solely for the purpose of fulfilling the User's order placed on the Website.
7.3. The User's personal data may be transferred to authorized state and judicial authorities only when there are legal grounds and a corresponding request.
7.4. In the event of a loss or disclosure of personal data, the Website Administration will inform the User about the loss or disclosure of personal data by any available means.
7.5. The Website Administration takes the necessary organizational and technical measures to protect personal information from unlawful or accidental access, destruction, alteration, blocking, copying, distribution, and other unauthorized actions by third parties.
7.6. The Website Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.
8. ADMINISTRATION'S OBLIGATIONS TO PROTECT PERSONAL DATA
8.1. The Website Administration undertakes and guarantees the following:
8.1.1. To use any obtained information solely for the purposes specified in section 5 of this Privacy Policy;
8.1.2. To ensure the confidentiality and preservation of the User's Personal information;
8.1.3. Not to disclose, without prior written consent of the User, or sell, exchange, publish, or disclose the User's personal data in any other possible way, except for the cases specified in paragraphs 7.2. and 7.3. of this Privacy Policy;
8.1.4. To take precautionary measures to protect the confidentiality of the User's personal data according to the practices commonly used to protect such information in existing business operations;
8.1.5. To suspend the use of personal data related to the relevant User, including preventing its deletion, from the moment of a request from the User, their legal representative, or an authorized body for the protection of personal data rights, during the verification period in case of detected false personal data or unlawful actions.
9. RESPONSIBILITY OF THE PARTIES
9.1. In case of failure to fulfill the obligations specified in this Privacy Policy, the Website Administration is liable for any damages incurred by the User due to the unlawful use of personal data, in accordance with current legislation, except in cases provided for in paragraphs 7.2. and 7.3. and paragraph 9.2. of this Privacy Policy.
9.2. The Website Administration is not liable for the loss or disclosure of the User's Personal information if such information:
9.2.1. Became or was public at the time of the loss or disclosure;
9.2.2. Was obtained from a third party before it was received by the Website Administration;
9.2.3. Was disclosed with the User's consent.
9.3. The Website Administration is liable in all matters not provided for in paragraph 9.2. of this Privacy Policy, in accordance with current legislation.
10. PROCEDURE FOR DISPUTE RESOLUTION
10.1. The User and the Website Administration resolve all disputes and disagreements arising from the relationships covered by this Privacy Policy through negotiations.
10.2. If the Parties fail to reach mutual agreement through negotiations as provided in paragraph 10.1. of this Privacy Policy, or if one of the Parties refuses to conduct negotiations, the dispute shall be referred to the court for consideration in accordance with the procedure established by the legislation of Ukraine.
11. FINAL PROVISIONS
11.1. The Website Administration has the right to make changes to this Privacy Policy without the User's consent or notification.
11.2. The new Privacy Policy comes into effect from the moment it is posted on the Website, unless otherwise specified in the new version of the Privacy Policy.
11.3. This Privacy Policy is available on the Website at the following URL: https://pride-salon.com/.
11.4. This Privacy Policy complies with the requirements of the Ukrainian legislation on personal data protection and contains detailed information about the data collected, its purpose, methods of collection, processing, usage, and protection.
11.5. Note for users from the European Union: this Privacy Policy is prepared in accordance with the obligations set forth by the General Data Protection Regulation (EU Regulation No. 2016/679 of April 27, 2016, or GDPR - General Data Protection Regulation).
